根据《外国人在中国就业管理规定》(劳部发〔1996〕29号),用人单位支付在中国就业的外国人的工资和福利待遇,应按我国有关法律、法规的规定办理,其所支付的工资可由企业与外国人就业者商定,但不得低于当地最低工资标准。
在中国就业的外国人的工作时间、休息休假、劳动安全卫生以及社会保障,按国家有关规定办理。
